AKC Registration for our Havanese and the Breeder

First and foremost, I'd like to thank everyone on this board as I have found so much informative info regarding the Havanese. I wish I had seen this forum prior to purchasing Cody. Don't get me wrong, I love Cody dearly and he is absolutely my special guy.
I had researched about purchaseing before getting Cody but perhaps I didn't research enough. I only want to get a puppy who is AKC registerable. I pruchased Cody from someone in New Jersey. When I had purchased cody I was told that the was AKC registerable and the contract states it as well. I purchased him from a woman in New Jersy who said it was an "Oops pregancy"... Looking back I'm thinking if they had no intension of breeding the dogs would have been neutered or spaded. Any way, when I pruchase him, she said she didn't have the papers for registration at the time and was working on the process. Not realizing what the process to Register AKC was needed, I didn't realize that this would later be a problem. When purchasing cody, I asked for a copy of papers for the parents registration since I hadn't had Cody reg. papers Father registered through CKc (Canada) and Mother AKC in US. I was told that the GrandFather is champion in Canada. 3 Months past and I did not receive the papers for AKC Reigstration. NJ Breeder said that the father who is CKC reigstered has to get registered AKC in US first and it has not yet been complete. I never heard back from her. I had contacted this woman numerous times since June, 2008 via email and phone and she never responds to my call or emails.
Anyone have any idea what I can do? Her contract specifically stated AKC registerable.
Any assistance would be greatly appreciated.

Perhaps contact the Havanese AKC and ask what they recommend. Wish I was more informative for you. Here is the web site for the Havansese...Good luck.

AKC doesn't like to get involved with breeder disputes, so the only way to resolve this may be through the legal system.

Glenda, this sounds like one of those life lessons that you just have to move on from and learn from. Clearly this person is unscrupulous. You are probably wasting your time pursuing her. At least you got a nice dog whom you love and who I'm assuming is healthy since you didn't say otherwise. If you don't plan to breed, I'm not sure how much the AKC registration matters anyhow.

If she is still advertising and selling dogs as AKC, then perhaps you have legal recourse, but who needs all that expense and trouble. Not worth it , in my opinion. But I would endeavor to contact your local Havanese society to see if they know anything about this breeder and if you can at least file a complaint. Another idea is to have a lawyer friend write her a letter, stating the facts of the matter. Sometimes this makes people like her comply, fearing legal action.

Possible you could even lodge a complaint against her with the Better Business Bureau in her city. Maybe someone else would benefit from that.

It is good for the local Havanese clubs to know, but they really can't do anything about it. All you will probably hear is "we hear a lot of complaints about him/her/them." Now, if she is a member of the local Havanese club, that is a different matter, but she probably isn't.

You are right, Kimberly, but at least I would get the word out about her anyway to the local Havanese community.

Sweeter32 -I contacted AKC a while ago and they said the registration papers have to come directly from the Breeder.
Kimberly, I think you're right. They only way to resolve is through the Legal System. I live in New York and She Lives in New Jersey. I did a search on the internet and NJ has a law that the breeder is required to give the paper within 90 days. I guess I can also sue for breach of contract.
Amy - when I got cody from her I didn't do the research about AKC Registering so I didn't even know I needed to get it from her. I was dumb. I doubt that she is still selling she said it was a 1 time. But then again she could have been dishonest about that as well. I haven't seen her selling advertosomgl pups online but then again...

Back in June, I even contacted the breeder where she got her male dog. That breeder is from Canada . She was very nice and contacted the breeder where I got Cody (I don't even know if I should call the woman a breeder) And then she contacted me (in June) It's a long process because she has to get her dog registered AKC first. Long process... 10 months?????
I should get her name out there so people know. Maybe I will try to let the local Havanese Club know and advise AKC that she is selling them as AKC registerable.

This forum is so informative... I wish I came here before getting him. I don't think she's a real breeder as I see what others do here with the pups, ie tests. But it still doesn't change how I feel about cody. He smart, loving, does a lot of tricks but VERY hyper.

It truly is a good experience because she seemed liked such a nice Lady. I should have known better. A lot of scammers out there. I noticed that there's someone who claims to be giving puppies away real inexpensive on petfind.com and puppyfind.com claiming that they're AKC, including Havanese. They claims to be selling their puppy because he's a missionary and needs to leave the country and can't the puppy with him.

I didn't want to go the route and sue but she's been dishonest with me so that my be the only resolution. I have a relative who's a lawyer so perhaps thats the best route to go with.

STAY AWAY!! We came across this from another forum member a long while back, maybe over a year ago. It's a scam and eventually this "missionary" does ask people for money. Oh, wasn't it Susan, with Yoda ? .... oh shoot... can't remember her forum name.

I agree that contacting the local Hav club won't hurt. If a CKC Cdn. breeder is connected with this woman in NJ and they've had shared litters before, then that is "interesting"!
